1. Acceptance of Terms

By installing the Discover Sentinel Chrome extension, accessing our website, or creating an account, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User", "you") and Discover Sentinel ("we", "our", "us").

If you do not agree to these Terms, you must immediately stop using the service and uninstall the extension.

We reserve the right to update or modify these Terms at any time. Changes become effective upon posting. We will make reasonable efforts to notify active subscribers of material changes via email or in-app notification. Your continued use of the service after any modification constitutes acceptance of the revised Terms.

2. Description of Service

Discover Sentinel is an AI-powered Chrome extension that analyzes articles and web pages against publicly known Google Discover eligibility signals. The service returns a readiness score, confidence analysis, and recommendations intended to help users evaluate content before publishing.

The service provides analytical insights only. It is an informational tool. It does not submit content to Google, modify your website, interact with Google's systems, or take any action on your behalf. All publishing and content decisions remain solely your responsibility.

3. No Guarantee of Results

We make no guarantees, representations, or warranties — express or implied — regarding Google Discover inclusion, search rankings, website traffic, revenue, or any other outcome resulting from use of the service.

Google Discover is an independent service operated entirely by Google LLC. Eligibility, inclusion, traffic volume, and content surfacing within Google Discover are determined solely by Google's proprietary algorithms, which may change at any time without notice.

A high readiness score within Discover Sentinel does not mean your content will appear in Google Discover. A low score does not mean your content will be excluded. Our analysis is based on publicly available information and third-party research — it may be incomplete, inaccurate, or outdated at any given time.

You acknowledge and agree that you use the service at your own risk and that any reliance on the analysis output is at your sole discretion.

4. AI Disclaimer

Discover Sentinel uses artificial intelligence models (currently powered by the Google Gemini API) to generate content analysis. AI-generated outputs are inherently probabilistic and may:

• Contain inaccuracies, errors, or hallucinated information.
• Provide incomplete or misleading assessments.
• Fail to reflect Google's actual or current ranking criteria.
• Produce different results for the same content when scanned at different times.

You must independently verify all AI-generated recommendations before making any content or business decisions based on them. We are not responsible for any actions you take, or fail to take, based on the output of our AI analysis.

The AI models we use are provided by third parties and may be modified, updated, or discontinued by their providers. Such changes may affect the quality, consistency, or availability of the analysis without prior notice.

5. User Responsibility

You are solely and entirely responsible for:

• The content you submit for analysis and ensuring you have the legal right to do so.
• All editorial and publishing decisions you make, whether or not they are informed by the service's output.
• Ensuring that your content complies with all applicable laws, regulations, and third-party rights.
• Maintaining the security of your account credentials.

You agree not to submit content that is unlawful, defamatory, infringing, obscene, or otherwise harmful. We are not responsible for the content you submit, publish, or distribute, nor for any consequences arising from your content decisions.

6. Third-Party Content Scanning & Report Sharing

Discover Sentinel allows you to scan any publicly accessible web page by its URL. This includes pages that you do not own or control. By using this feature, you acknowledge and agree to the following:

• Your responsibility. You are solely responsible for your decision to scan any third-party URL and for how you use, share, distribute, or publish the resulting analysis report. We do not verify whether you have authorization to scan a given URL.
• Report contents. Scan reports may contain the URL of the scanned page, a readiness score, AI-generated analysis, and recommendations. This information is generated automatically and reflects the AI model's assessment at a specific point in time.
• No endorsement or validation. A score or analysis generated by Discover Sentinel does not constitute an objective, authoritative, or definitive evaluation of any website or content. It is an automated AI opinion based on limited publicly known signals and must not be presented or relied upon as fact.
• Sharing reports. If you share a report (via public link, PDF export, or any other means), you do so entirely at your own risk. You are responsible for ensuring that sharing does not violate any applicable laws, third-party rights, or contractual obligations.
• No liability for shared reports. We expressly disclaim any and all liability for claims, damages, losses, or disputes arising from your sharing, publication, or distribution of scan reports — including but not limited to defamation claims, reputational harm, unfair competition claims, or intellectual property disputes.
• Removal requests. If a third party believes that a shared report infringes their rights, they may contact us at support@discoversentinel.com. We reserve the right, but are not obligated, to remove or restrict access to any shared report at our sole discretion.

You agree to indemnify and hold Discover Sentinel harmless from any claims or damages arising from your scanning of third-party content or your sharing of reports.

7. Fair Use Policy

Each plan includes defined scan limits designed to ensure fair and equitable access for all users:

• Free plan: 15 scans per month.
• Starter plan: 10 scans per day.
• Trial: 35 scans per day for 5 days.
• Pro plan: 35 scans per day.

Unused scans do not roll over between periods. Scan limits are enforced automatically.

Session limits: Free accounts are limited to 1 concurrent active session. Starter, Trial, and Pro accounts are limited to 2 concurrent active sessions. If the session limit is exceeded, the oldest active session will be automatically terminated. Accounts are intended for use by a single individual and may not be shared with others.

You may not use bots, scripts, automated tools, or any other means to circumvent scan limits or session limits, create multiple accounts to exceed quotas, share account credentials with third parties, or abuse the service in any manner. Systematic, automated, or excessive use that disrupts service availability for other users constitutes a violation of these Terms.

We reserve the right to throttle, suspend, or terminate access for any user who violates this Fair Use Policy, with or without prior notice.

8. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, disassemble, or attempt to extract the source code of the extension, website, or any part of the service.
• Resell, sublicense, redistribute, or provide access to the service to third parties.
• Use the service for any illegal purpose or in violation of applicable law.
• Interfere with or disrupt the integrity, performance, or security of the service or its infrastructure.
• Transmit malware, viruses, or any harmful code through the service.
• Misrepresent your identity, impersonate others, or create accounts under false pretences.

9. Subscription & Billing

Paid plans are available on a monthly or annual billing cycle. All payments are processed by Lemon Squeezy, which acts as the merchant of record for all transactions. By purchasing a subscription, you agree to Lemon Squeezy's terms of service and billing policies.

• Subscriptions renew automatically at the end of each billing cycle (monthly or annually) unless cancelled before renewal.
• Annual subscriptions are billed as a single upfront payment for the full year.
• Prices are listed in EUR (€) and may be subject to applicable taxes (including VAT) depending on your jurisdiction, calculated by Lemon Squeezy.
• We reserve the right to change subscription pricing upon at least 30 days' notice. Price changes apply to the next billing cycle following the notice period.
• You are responsible for ensuring that your payment method is valid and that funds are available. Failed payments may result in service suspension.

10. Free Trial

We may offer a 5-day free trial providing full access to Pro plan features (35 scans per day). The trial is available once per user.

At the end of the 5-day trial period, your subscription will automatically convert to a paid Pro monthly plan unless you cancel before the trial expires. You will be charged the applicable Pro monthly rate at the time of conversion. You may cancel the trial at any time through your account settings or via Lemon Squeezy — no questions asked.

We reserve the right to modify, limit, or discontinue the trial offer at any time.

11. Cancellation Policy

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period — you will retain access to paid features until that date.

Upon cancellation, your account reverts to the Free plan. Scan history retention will be subject to Free plan limitations.

12. Refund Policy

Subscription fees are non-refundable, except where required by applicable law.

If you are a consumer in the European Union, you have a 14-day statutory right of withdrawal under Directive 2011/83/EU from the date of purchase. However, by using the service (performing scans) during this period, you expressly consent to the provision of the digital service and acknowledge that you lose your right of withdrawal once the service has been fully performed.

All refund requests that qualify under applicable consumer protection law are handled by Lemon Squeezy as the merchant of record.

13. Service Availability

The service is provided on an "as-is" and "as-available" basis. We do not warrant that the service will be uninterrupted, error-free, secure, or available at all times.

We may suspend or restrict access to the service for maintenance, updates, security incidents, or other operational reasons without prior notice or liability.

14. No Uptime Guarantee

We do not guarantee any specific uptime percentage or service level. While we aim to maintain reasonable availability, the service may experience downtime due to server issues, third-party service outages (including the Google Gemini API), network disruptions, or scheduled maintenance.

We shall not be liable for any damages, losses, or missed opportunities resulting from service unavailability or degraded performance.

15. Data Loss Disclaimer

While we implement reasonable measures to protect service data, we do not guarantee that your data (including scan history, account settings, or analysis results) will be preserved indefinitely or free from loss or corruption.

We are not responsible for any loss of data resulting from service outages, system failures, security incidents, or any other cause. You are encouraged to export or back up any important data independently.

16. Limitation of Liability

To the maximum extent permitted by applicable law:

• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of profits, loss of revenue, loss of data, loss of traffic, loss of business opportunities, or reputational damage — however caused and regardless of the theory of liability.
• We shall not be liable for any damages arising from reliance on AI-generated analysis, scoring, or recommendations.
• We shall not be liable for actions or inactions of third-party services we rely upon (including Google Gemini API and Lemon Squeezy).

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the use of the service shall not exceed the total amount you paid to us in the 30 days immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

17. Indemnification

You agree to indemnify, defend, and hold harmless Discover Sentinel, its operators, affiliates, and their respective officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use or misuse of the service.
• Your violation of these Terms.
• Your violation of any applicable law or third-party rights.
• Content you submit for analysis.
• Your sharing, publication, or distribution of scan reports (including reports about third-party websites).
• Any actions or decisions you make based on the service's output.

This indemnification obligation applies to the extent permitted by applicable law. If you are a consumer in the EU, this clause applies only where the claim arises from your wilful misconduct or negligence.

18. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government action, power failures, internet or telecommunications failures, third-party service outages (including API providers), cyberattacks, or any other force majeure event.

19. Intellectual Property

All components of the Discover Sentinel service — including the Chrome extension, website, scoring algorithms, user interface, documentation, branding, and all related intellectual property — are and remain the exclusive property of Discover Sentinel or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the service for your own lawful purposes in accordance with these Terms. This licence does not convey any ownership rights.

You retain all intellectual property rights to the content you submit for analysis. We do not claim ownership of your articles, web pages, or any content you scan.

20. Account Termination

We reserve the right to suspend or terminate your account, with or without notice, if we reasonably believe that:

• You have violated these Terms or any applicable law.
• You have engaged in abusive, fraudulent, or harmful behaviour.
• You have attempted to circumvent scan limits, access controls, or security measures.
• Your use poses a risk to the service, its infrastructure, or other users.

Upon termination for cause, you forfeit any remaining subscription time and are not entitled to a refund, except where required by applicable law. We may also retain data as necessary to enforce these Terms or comply with legal obligations.

You may delete your account at any time through your account settings, or by contacting us at support@discoversentinel.com.

21. Modification of Service

We reserve the right to modify, update, suspend, or discontinue any part of the service — including features, pricing, scan limits, AI models, or the entire service — at any time, with or without notice.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

22. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict-of-law principles. Where applicable, the laws of the European Union (including consumer protection directives) shall also apply.

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Spain, without prejudice to any mandatory consumer protection provisions that may grant you the right to bring proceedings in the courts of your country of residence.

23. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely approximates the intent and economic effect of the original.

24. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Discover Sentinel regarding the use of the service, and supersede all prior agreements, understandings, or representations.
